Terms of Service & End User License Agreement (EULA)
HealthAgent is an informational self-quantification and prompt formatting tool. It is NOT a medical device, medical diagnostic system, or clinical decision support software. Telemetry summaries, moving averages, and any AI responses generated with these payloads are intended solely for personal wellness, fitness tracking, and informational purposes. HealthAgent does not provide medical advice, diagnosis, or treatment. Always consult a qualified physician or healthcare provider before making any medical decisions or modifying your diet, exercise, or health regimen. If you believe you are experiencing a medical emergency, immediately contact your local emergency services.
1. Acceptance of Terms
By downloading, installing, accessing, or using the HealthAgent application ("App", "HealthAgent") or associated web services at healthagentapp.com, you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you do not agree to these terms, do not install or use the App.
2. License Grant and Scope
Teemu Harju ("Developer", "Licensor") grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use HealthAgent on iOS devices that you own or control, solely for your personal or internal use, subject to the Apple Media Services Terms and Conditions and Standard Licensed Application End User License Agreement (Apple Standard EULA).
3. HealthKit Biometric Data & On-Device Processing
HealthAgent connects to Apple HealthKit on your device with your explicit authorization. You acknowledge and agree that:
- All data queries, calculations, moving averages, and prompt generation take place 100% locally on your iOS device.
- HealthAgent does not transmit, store, or replicate your HealthKit records on any external server managed by the developer.
- You have complete discretion over which HealthKit categories (e.g., Heart Rate, HRV, Workouts, Sleep, Active Energy) you grant the App permission to read. You may revoke these permissions at any time via iOS Settings > Health > Data Access & Devices > HealthAgent.
4. Exporting Context to Third-Party AI Assistants
HealthAgent allows you to copy structured biometric summaries or invoke universal links (e.g., https://healthagentapp.com/export) to export context for use in third-party artificial intelligence assistants, including but not limited to OpenAI ChatGPT, Anthropic Claude, and xAI Grok.
- User Control: You maintain absolute control over every export action. No biometric data is sent to an AI assistant without your direct initiation or confirmation.
- Third-Party Terms: Once biometric text is pasted or transmitted into a third-party AI assistant, the handling and retention of that information is governed exclusively by that third party's terms and privacy policies. The Developer of HealthAgent assumes no responsibility or liability for third-party AI processing, errors, inaccuracies, or hallucinations.
5. Prohibited Uses
You agree not to:
- Use HealthAgent for any critical clinical, medical, or diagnostic evaluation.
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App, except to the extent permitted by applicable law.
- Use the App in violation of any applicable local, state, national, or international laws.
6. Disclaimer of Warranties
THE APPLICATION AND ASSOCIATED SITES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE BIOMETRIC SUMMARIES WILL BE ERROR-FREE OR UNINTERRUPTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING HEALTH COMPLICATIONS, PERSONAL INJURY, LOSS OF DATA, OR INACCURATE AI OUTPUTS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.
8. Changes to this Agreement
We may update this Agreement from time to time. Changes will be posted to https://healthagentapp.com/terms with an updated effective date. Continued use of the App following any changes indicates acceptance of the revised terms.
9. Governing Law and Contact
